These Terms of Service ("Terms") govern your access to and use of the https://lalospartykitchen.com/ and your purchase of products and services from Lalo's Party Kitchen, operated by Lalo's Lunchbox, LLC. By using our website or placing an order, you agree to these Terms. Please read them carefully.
Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order or enter into these Terms.
Ordering and payment
Payment must be completed before we process and prepare your order. We accept all major debit and credit cards (Visa, Mastercard, American Express, and Discover).
All prices are displayed in United States dollars (USD). Applicable taxes are calculated and added at checkout, so the full amount payable is shown before you confirm your order.
Pricing and product information
We make every effort to display accurate pricing and product information. In the event of a pricing or typographical error, we reserve the right to correct the error and to cancel or decline any order placed based on incorrect information, even after an order has been submitted. Prices and product availability are subject to change without notice.
Order cut-off and scheduling
Because each box is freshly sourced and prepared, orders for parties on a Friday, Saturday, or Sunday must be placed by 9:00 AM CT on the Tuesday before that event weekend. Late orders may be accepted on a limited basis, subject to availability, and may be subject to a late-order fee. We reserve the right to decline orders that cannot be fulfilled to our quality standards.
Please note that Party Box orders are not available for events scheduled on Monday through Thursday.
Changes and cancellations by the customer
You may request changes to your order, such as a different theme, party size, or delivery details, up to 7 days before the party. We will make reasonable efforts to accommodate changes, but they are not guaranteed within 72 hours of the party once food, supplies, or custom items have been ordered or prepared. Cancellation refunds are governed by our Return & Refund Policy.
Cancellation by Lalo's Party Kitchen
While we strive to fulfill every order, we reserve the right to cancel an order under certain circumstances, including:
- Payment authorization failures or incomplete payment
- Suspected fraudulent or unauthorized transactions
- Severe weather, road closures, or other events that prevent safe delivery
- Incorrect or incomplete delivery information that cannot be resolved in time
- Circumstances beyond our reasonable control or other unforeseen events
If we cancel your order, we will notify you as soon as possible and provide a full refund of any amounts paid for undelivered products or services.
Food allergies
While we strive to provide accurate ingredient information, products may be prepared by third-party suppliers and may contain or come into contact with common allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, sesame, fish, and shellfish. Customers are responsible for reviewing ingredient information and determining whether products are suitable for their guests.
Third-party products
Food, beverages, and party supplies may be sourced from third-party vendors. Product availability and ingredients may vary.
Product substitutions
If a specific item becomes unavailable, we may substitute a similar item of equal or greater value. We will make reasonable efforts to notify customers of substitutions.
Delivery responsibility
Customers are responsible for providing accurate delivery information and for ensuring that someone is available to receive the party box at the scheduled delivery time.
Photos and marketing
We may occasionally photograph party boxes, products, or deliveries for marketing purposes. We will not use photographs that identify customers, children, or private residences without permission.
Promotions and discount codes
We may offer promotions, discount codes, or special offers. Unless otherwise stated, the following terms apply:
- Promotions and discount codes must be applied at checkout and cannot be applied retroactively to completed orders.
- Only one discount code or promotional offer may be used per order unless otherwise specified.
- Promotions have no cash value and cannot be redeemed for cash, credit, or gift cards.
- Certain products, services, add-ons, taxes, or special event packages may be excluded.
- Promotions may be subject to expiration dates, minimum purchase requirements, or other stated conditions.
- Promotional discounts are non-transferable and may only be used by the customer who earned or received them.
- Orders that are canceled or refunded may result in the forfeiture of any promotional discounts, rewards, or loyalty credits associated with the order.
- We reserve the right to modify, suspend, or discontinue promotions at any time without prior notice.
- Promotional offers may be canceled or adjusted if misuse, fraud, or technical errors are identified.
Additional terms applicable to a specific promotion will be provided with that offer.
Intellectual property
All content on this website, including text, graphics, logos, and images, is the property of Lalo's Party Kitchen or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content without our prior written permission.
Acceptable use
You agree to use our website only for lawful purposes and not to engage in any activity that could damage, disable, or impair the website or interfere with another party's use of it.
Disclaimer of warranties
Our products and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated, whether express or implied. This does not limit any rights you may have under applicable law.
Limitation of liability
To the fullest extent permitted by law, Lalo's Party Kitchen's liability for any claim relating to an order shall not exceed the amount paid for that order.
Indemnification
You agree to indemnify and hold harmless Lalo's Party Kitchen from any claims, losses, or damages arising out of your violation of these Terms or your misuse of our website or products.
Changes to these Terms
We reserve the right to update these Terms and our policies at any time. Updated versions will be posted on our website and become effective upon posting. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Governing law
These Terms and policies shall be governed by the laws of the State of Minnesota.
